After the Supreme Court ruled Section 3 of the Defense of Marriage Act (DOMA) is unconstitutional, same-sex couples legally married in the U.S. or anywhere else in the world are privileged to the same immigration rights including the ability to submit an immigrant visa petition on behalf of a spouse. In light of the Supreme Court’s recent decision preventing states from denying same-sex couples the ability to marry, same-sex couples may now be legally wed in any U.S. state and enjoy the same protection under the law as any other married couple.
