About Bond Hearings

New York City Immigration Lawyer

If you or a loved one has been detained by Immigrations Customs Enforcement (ICE), it is vital to have an aggressive New York City immigration attorney who can protect your rights and work to see that your case proceeds in accordance with the law. At Feiner & Lavy P.C., Attorneys at Law, our 40 plus years of experience in successfully applying immigration law permits us to know when your situation is being properly addressed and what to do if that is not occurring. In cases of immigration detention, part of the superior customer service we provide is working to secure your release as quickly as possible.

When you are being held, there are two matters that will need resolution. One is the alleged violation of immigration laws and the second is obtaining a bond so that you can be released from immigration detention.

The first step in getting a bond for your release is to verify that you are eligible. In most cases, unless you are a terrorist, committed an aggravated felony or are classified as an arriving alien, you will be qualified for a bond. If you are eligible, our next action is to prepare and file a motion to the Immigration court for a speedy bond hearing, so as to lessen the amount of time you are being detained.

Eligibility for a Bond

Our firm will represent you at your hearing in order to provide the court with evidence to show that you are eligible for a bond and to argue that one should be granted. $1500.00 is the minimum bond that will be given and they normally go from this amount up to tens of thousands of dollars. A judge will decide on your bond based on any danger he considers you may be to the community, if you are a flight risk, any criminal history and whether or not you have been stably employed. Other factors such as ties to the community, your immigration history and your ability to pay the bond will be considered as well.

As part of our commitment to fight on your behalf, if your request for bond is denied or you feel the amount is excessive we can appeal the decision to the Board of Immigration Appeals.

Quickly contact a New York City immigration lawyer from our firm if you have been detained by Immigration and need help in securing your release.
