When you are being held, there are two matters that will need resolution. One is the alleged violation of immigration laws and the second is obtaining a bond so that you can be released from immigration detention.
The first step in getting a bond for your release is to verify that you are eligible. In most cases, unless you are a terrorist, committed an aggravated felony or are classified as an arriving alien, you will be qualified for a bond. If you are eligible, our next action is to prepare and file a motion to the Immigration court for a speedy bond hearing, so as to lessen the amount of time you are being detained.
Eligibility for a Bond
Our firm will represent you at your hearing in order to provide the court with evidence to show that you are eligible for a bond and to argue that one should be granted. $1500.00 is the minimum bond that will be given and they normally go from this amount up to tens of thousands of dollars. A judge will decide on your bond based on any danger he considers you may be to the community, if you are a flight risk, any criminal history and whether or not you have been stably employed. Other factors such as ties to the community, your immigration history and your ability to pay the bond will be considered as well.
