Immigration laws have been routinely revised and permanent residents formerly used Section 212 (c) of the Immigration and Nationality Act to obtain a waiver which permitted them to legally stay in the U.S. This section was cancelled by Congress and relief from deportation can now be achieved by the process known as cancellation of removal. Unfortunately, this is a much more restrictive law that 212 (c) and in order to utilize it, you must have been a resident for 5 years, may not have been convicted of an aggravated felony and must have resided in the U.S. with any immigration status for 7 years.

How a 212 C Waiver Can Benefit You

We will review your case to see if cancellation of removal is the best way to proceed. If not, there may still be a way to use the relief provided by a 212 (c) waiver. Thanks to a U.S. Supreme Court ruling, lawful permanent residents who plead guilty and were convicted of a crime at the time that 212 (c) was in effect may still be eligible for the same relief that they would have had.
